But be careful, folks\u2014some of these offers are just too good to be true.<\/p>\n<p>In a nutshell, these promoters are pushing ineligible people to file a claim for the ERC while charging hefty upfront fees or fees based on the refund amount. But wait, there&#8217;s more! They might not even tell you that you have to reduce the wage deductions you claimed on your business&#8217; federal income tax return by the amount of the credit. Sneaky, right?<\/p>\n<p>The IRS has been warning about this since last fall, but some people are still trying to claim the ERC during the 2023 tax filing season. So, let&#8217;s talk about <a href=\"https:\/\/www.irs.gov\/coronavirus\/employee-retention-credit#:~:text=Who%20Is%20Eligible,an%20appropriate%20governmental%20authority%20or\" rel=\"noopener\" target=\"_blank\">who can actually qualify for the ERC<\/a> and how to report any funny business you come across.<\/p>\n<h2>Who Qualifies for the ERC?<\/h2>\n<p>The ERC is a refundable tax credit for businesses that kept paying employees during a shutdown due to the pandemic or experienced significant declines in gross receipts. Here&#8217;s what you need to be eligible:<\/p>\n<ul>\n<li>Had a <a href=\"https:\/\/www.thetaxadviser.com\/issues\/2022\/oct\/employee-retention-credit-navigating-suspension-test.html\" rel=\"noopener\" target=\"_blank\">full or partial suspension<\/a> of operations due to COVID-19-related orders from an appropriate governmental authority during 2020 or the first three quarters of 2021<\/li>\n<li>Experienced a significant decline in gross receipts during 2020 or a <a href=\"https:\/\/www.irs.gov\/newsroom\/employee-retention-credit-2020-vs-2021-comparison-chart\" rel=\"noopener\" target=\"_blank\">decline in gross receipts <\/a>during the first three quarters of 2021<\/li>\n<li><a href=\"https:\/\/www.law.cornell.edu\/definitions\/uscode.php?width=840&#038;height=800&#038;iframe=true&#038;def_id=26-USC-1721657554-222975447&#038;term_occur=999&#038;term_src=title:26:subtitle:C:chapter:21:subchapter:D:section:3134\" rel=\"noopener\" target=\"_blank\">Qualified as a recovery startup business<\/a> for the third or fourth quarters of 2021<\/li>\n<\/ul>\n<p>Keep in mind that you can&#8217;t claim the ERC on wages that you reported as payroll costs in obtaining <a href=\"https:\/\/home.treasury.gov\/system\/files\/136\/PPP-Forgiveness-Factsheet-508.pdf\" rel=\"noopener\" target=\"_blank\">Paycheck Protection Program loan forgiveness<\/a> or that you used to claim certain other tax credits.<\/p>\n<h2>Reporting ERC Fraud<\/h2>\n<p>If you come across any illegal tax-related ERC claims and activities, you can report them by submitting a completed <a href=\"https:\/\/www.irs.gov\/businesses\/small-businesses-self-employed\/abusive-trust-tax-evasion-schemes-referrals-contacts\" rel=\"noopener\" target=\"_blank\">Form 14242<\/a> to the IRS Lead Development Center in the <a href=\"https:\/\/www.irs.gov\/about-irs\/office-of-promoter-investigations-at-a-glance\" rel=\"noopener\" target=\"_blank\">Office of Promoter Investigation<\/a>s.
